1.3.3 James Valley Calling Card Service

(A) Description

James Valley Calling Card Service is an optional calling plan, which allows customers to make calls from any phone in the U.S., utilizing 8XX access methodology. Access to the service is gained by dialing a toll-free “8XX” number. After dialing the 8XX access number, the caller receives a voice prompt, and then enters an authorization code. The caller next receives another prompt and dials the called party.

(B) Terms and Conditions

(1) James Valley Calling Card rates apply to Interstate and Intrastate Calling Card calls originating from customers who subscribe to this plan, and which terminate within the 50 United States.

(2) James Valley Calling Card service and its rates do not apply to any calls eligible for rates and / or discounts set forth in other Optional Calling Plans offered in this Tariff. No additional discounts are available to subscribers to this plan.

(3) This calling plan will be available to all classes and grades of customer service within the restrictions and the limitations set forth in other provisions of this Price List.

(4) Participants in James Valley Calling Card Service are eligible to participate in other James Valley Optional Calling Plans offered in this Tariff.

(5) The customer must be PIC’ed (must choose James Valley Long Distance) as its Preferred Interexchange Carrier choice (PIC) for both Interlata and Intralata jurisdictions.

(6) Billing Arrangements

(a) The billing period for James Valley Calling Card Service will be determined by the toll billing date for the associated lines. The plan may be activated at any time during the billing period.However, no proration of charges is allowed. When withdrawing from the plan, the service will cease with the current toll billing period.

(B) Terms and Conditions

(6) Billing Arrangements

(b) Minimum timing per message is 18 seconds. Timing of additional minutes and fractions thereof will be rounded to the next 1/10 of a minute (6 seconds) increment for each message. Charges are rounded up to the next whole cent on each call.

(7) Termination of Plans

James Valley Telecommunications, LLC may terminate this “James Valley Calling Card Service” Optional Call Plan and withdraw the rates set forth below, at any time, following appropriate tariff revisions.

(C) Rates and Charges

(1) Service Order charges are not applicable to this plan.

(2) James Valley Calling Card Service rates are applicable regardless of distance, time of day, day of week and/or holidays, for all eligible Interstate and Intrastate calls.

(3) The rates below apply to all Interstate and Intrastate calls included in James Valley Calling Card Service and are in addition to the charges applicable to the class and type of local exchange service to which the customer subscribes.

*Monthly Minutes of Use are determined based on combining the minutes of use from all James Valley Optional Calling Plans to which a customer is subscribed to, such as; 1+ Direct Dialed, James Valley 800 Service, James Valley Calling Card, etc. The total minutes of use from all Optional Calling Plans determine the per minute rate for James Valley Calling Card Service.

Example

Customer utilized a total of 2001 minutes

1+ calls = 1950 minutes

Calling Card Calls = 51 minutes

Based on total minutes of 2001, Calling Card Calls are billed at 0.15 per minute of use (51 minutes @ 0.15).

(C) Rates and Charges

(4) Miscellaneous Charges

When a customer initiates a James Valley Calling Card call, which requires operator intervention, the customer will be charged a call set-up fee. Operator intervention fees are as follows:

(a) Operator Call Set Up $0.80

(b) Rate Quotes and Dialing Instructions $0.60 (per call)

(c) Directory Assistance $0.80

(d) Manual Completion Surcharge $0.20 (allows calls from rotary-dial telephones)

(5) Pay Phone Surcharge

Calls, which originate from lines that are identified as pay phones (coin, coinless, public and semi-public) will incur a “pay phone surcharge” of $0.30 per call.
